Agreement to Build Good Neighbour Fence

THIS AGREEMENT  dated as of [Effective Date of Agreement ( July 1, 2024)] between

[Name of First Party], of [Address of First Party] (the “First Party”) and [Name of Second Party], of [Address of Second Party] (the “Second Party”).

WHEREAS:

The First Party is the registered owner of the property municipally known as [Municipal Address of First Party’s Property] and legally described as Legal Description of First Party’s Property;

The Second Party is the registered owner of the property municipally known as[Municipal Address of Second Party’s Property] and legally described as Legal Description of Second Party’s Property; and

The parties wish to build a common fence along the boundary between the First Party’s Property and the Second Party’s Property (the “Common Boundary”);

NOW THEREFORE  in consideration of the mutual covenants and conditions hereinafter set forth and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows:

1.The parties agree to build a fence along the Common Boundary (the “Good Neighbour Fence”).

2.The parties agree to retain CheaperFence, LLC to construct the Fence and that the cost of the contractor, materials and other costs of constructing the Fence shall be shared equally by the parties.

3.The parties agree to maintain the Fence in a good state of repair and to share equally all costs associated with the maintenance and repair thereof.

4.Neither party will register this Agreement or any notice thereof on title to the First Party’s Property or the Second Party’s Property.

5.This Agreement shall remain in full force and effect for a period of [Term of Agreement( 20 years)] after which time it shall become null and void.

6.This Agreement shall ensure to the benefit of and be binding upon the respective heirs, executors, administrators and assigns of each of the parties hereto.

IN WITNESS WHEREOF  this Agreement has been executed by the parties hereto as of the date first above written.
